An After-school Provider Laments the Crazy Rules

Hi Folks! Here’s yet another look at some insanely overprotective, unproductive rules governing anything having to do with kids. This rant/lament comes from Rick Rood, director of an on-site after-school child care program in the San Francisco Bay Area.  He has worked in the profession since 1990, and provides workshops and coaching for education professionals who work with school-age children.  He blogs at AfterschoolAnswers and is currently finishing his new book, “The Three Secret Pillars of Behavior Guidance,” even while he and his wife are raising kids aged 5, 16, and 17. This note came in response to a post about a YMCA that wouldn’t let a mom bring her 3-year-old in to use the bathroom because this was against the rules. – L

Dear Free-Range Kids:  I run an after-school program, and if that parent had come to our center, I would’ve had to tell them the same exact thing.  Our organization (we’re a string of 16 centers run by a rec and park organization) has a policy that outsiders are not allowed to use our restrooms. Why not?

One simple reason — liability.  The (very) sad fact is that the policy comes from our insurance company. I do my best to be a “Free-Range” director.  I don’t make these policies, and there are many rules and regulations with which I personally don’t agree. But it goes deeper than that.  Because of this “bubble-wrap” mentality, out-of-school-time staff have become more and more infected over the years with this insidious “worst-case scenario” type of thinking.

Some examples? Recently one of my teachers reported me to my boss for a Free-Range comment I had made.  One day, one of our children decided to sneak away from school and not come to the afterschool program.  This resourceful 8-year-old made it pretty much clear across our medium-sized town, heading to a friend’s house.  We followed our policies when he didn’t show up to our program: parents and police were called, and they tracked him down in pretty short order. After the dust had settled, I made a comment to one of our teachers (who I mistakenly figured held similar Free-Range ideas), saying that, while it was good that we found the boy, I was impressed with the boy’s resourcefulness and that maybe, as a culture, we shouldn’t call up visions of child molesters and abductors every time something doesn’t go as planned. The teacher went to my boss, and told her that he didn’t think I was very serious about protecting the children in our care.

Another policy: Kids can’t walk home on their own.  Again, liability.  How much could we be sued for if a kid breaks their leg or goes missing on the short walk home (we’re a neighborhood school),  even if the parent has given permission?  Frustrating to me because the odds that nothing bad will happen within a two-block walk are pretty astronomical, and then add to that the VERY tiny chance that their parent will pursue legal action (these are parents that we, as a rule, work together with as partners- and we have very good relationships with our parents).

Here’s a corker. Our local Little League uses the fields on our school grounds for practice and games.  Can we release the kids to just walk across the field (again on the SAME physical grounds) to practice?  Heck no… we require a “responsible adult” to come and sign them out and walk them the 100 yards to practice).  And, even better, by policy that “responsible adult” cannot be one of our staff members (even if the parents say it’s okay and we walk them every step of the way).

Finally, here’s a spot where I’ve rebelled (although quietly). At one of our “sister centers” (on the grounds of another local school)… they had a kindergartner who fell off the monkey bars while playing in the afterschool program and broke her arm.  Immediately, and with almost scary domino-like action, many of the other local centers (including the one in question) banned kindergarteners from the play structures (even though they’re labeled for use by kids 5-12 years of age).  No one ever made it an official policy, so my kindergarteners continue to enjoy play time on the play structure.

My main philosophy in afterschool care is that we exist to facilitate the emotional and social growth of children.  And if we’re going to succumb to the bubble-wrap philosophy of raising kids, then our mission is doomed from the start! At my center, kids will be allowed to play freely on the play structure, kids will be allowed to wrestle in the grass, and I will make free range choices in every area where they have not already been banned and by the regulating agencies, lawyers and insurance adjusters.  And unlike some of my fellow co-workers, I will not succumb to the “worst-first” type of thinking that stunts the social and emotional growth of the next generation. – Rick Rood

You Read it Here First: The Deaf Pre-Schooler Story

Hi Readers! Just had to crow. The story about Hunter, the deaf pre-schooler who was told to change his name because it violated the school’s anti-gun policy, was sent to us by a gal in Hunter’s neck of the woods — Nebraska — on Monday night, which is when I posted and tweeted  it. By Tuesday afternoon, the story had gone ’round the world. Google it — you can’t miss it. On Yahoo’s home page alone it got 17,000+ comments. And despite the fact neither this site nor the one where I’m guest-posting this month, The Agitator, are getting credit (see this),   Free-Range Kids was, as far as I can tell, the first to bring it to national attention.

What thrills me about that is knowing that the press is peeking in on us, and ready to take up the anti-stupidity standard. It’s also thrilling to see how obvious it is to most humans that Zero Tolerance too often means Zero Brains. Hunter’s story may go on to achieve “The Lady Who Sued McDonald’s For Hot Coffee” status (but don’t start debating it here!), used as a sort of shorthand for, “Come on — under the pretense of caring, this is just INSANE.”

We could use a story like that, because it is time to re-think so many schools rules and time to remember our kids just aren’t that vulnerable. For me it is also time to thank YOU, readers, for always sending in the best examples of what’s wrong with the way we treat kids, and what’s right.

How Should a School Respond When ONE Parent Says, “That’s Too Dangerous!” ?

WHEN ANXIOUS PARENTS ARE THE PROBLEM, WHAT IS THE SOLUTION? by TIM GILL

How should schools, nurseries, kindergartens and other education, childcare and play services respond to anxious parents? I was asked this question recently by an Australian early years educator who heard me speak a couple of months ago.

She explained that her setting’s outdoor space was very small and sparse, but that it was located in some more extensive school grounds. She was keen to take the children into the grounds, so they could play games that they do not have room for in their own yard. She wanted to do this, not only because of the extra space, but also to prepare the children for the transition to the ‘big school’ that many of them would soon be joining. She continues:

Unfortunately, one parent has refused permission for their child to have anything to do with the school, because “she’s not going to that school next year”. I’ve spoken to my managers, and there’s nothing I can do about one parent preventing all the children from going to the school. I am not able to ask the child to stay home on those days. I am not able to leave her with one staff member at the setting. I am not able to leave her at the school office. And when I appealed to the mother she said that it is my problem.

It is amazing that one parent can determine what all the other children will be able to do! I asked my managers if they could make it a compulsory policy from next year’s enrolments that parents give permission before enrolling to access the school grounds. However, they said no, as I am supposed to engage with our community, according to regulations.

They did say they would look into it, as they hadn’t come across a parent like this before. I said they should, because there’s always one parent! If a parent doesn’t give permission then it’s certainly to their child’s detriment, but to affect everybody else’s rights to go on an excursion or to do an activity that is deemed beneficial and educational is not right.

Note the real problem here. It is not parents as a group. It’s that because of the policies and procedures of the setting, the views of a single parent are enough to derail things.

baby-knee-padsParents, like the rest of us, are on a spectrum when it comes to their attitude to risk. At one end of this spectrum, some parents apparently feel the need to protect their children through against all possible harm, even the harm from crawling on a hardwood floor.

All too often, systems and procedures effectively give risk averse parents a veto. Schools, services and settings feel under pressure to set their benchmark at the level of the most anxious parent. Often, the result is that all children lose out on some vital learning experiences.

My take-home message to services – and especially service managers – is simple. If you want to allow all children the chance to spread their wings a little, you cannot set your bar at the level of the most anxious parent. In the nicest possible way, you need to be assertive with the ones at the fearful end of the spectrum. They should not be allowed to think that they have a veto on what you offer to children.

School Nurse Watches Boy Lose Consciousness Because “Inhaler Form Not Signed”

Readers — The very best thing about this horrifying story (tweeted about it the other day) is this perfect comment about the school nurse who watched a boy slip into unconsciousness because of a form not signed. (It didn’t even matter that he had his medicine with him and the medicine had his name on it):

Policy is meaningless if it is followed in blind obedience without consideration of the full consequences of not deviating.

Right! I think that a lot of what is driving us all crazy about incidents like this, and Zero Tolerance absurdities, and even CPS travesties, boils down to that simple problem: Blind obedience. So the question is:

How do we RE-AUTHORIZE people to use their brains and hearts?

That’s a really key issue. It’s the issue when guards won’t let a young boy  use the community center bathroom because it’s after hours. It’s the issue when a school suspends kids for a “prank” that’s really a morale booster. It’s the issue when a parent gets a ticket for letting their kid wait in the car, even though the child is safe and comfortable. Blind obedience to overarching laws written  with an eye to avoiding lawsuits, or an eye to uber-safety.

We have to change the laws and we have to change the mentality of the people enforcing them. Any ideas of how to get there are greatly appreciated. – L.

H.S. Coach Fired for Leaving 2 Misbehaving Seniors Behind (And an Update)

Hi Folks! News moves so fast. Here’s a story I was going to post tomorrow, but here it is today — complete with an update that just came in! 

Ricky Sargent, a football and track coach in Hempstead, Texas, was fired last week for leaving two seniors behind at a restaurant for about an hour, at night, after they misbehaved and refused to get back on the team bus.

The young men were acting up on their way back from a meet, and as a punishment they were told they wouldn’t be allowed off the bus to eat. But eventually they DID get off — and then refused to get back on. The adult or adults with the team at the time called Coach Sargent, who okayed the decision to leave the troublemakers behind, saying he’d come by to sit with them himself until their parents came to pick them up.

Which he did.

And for which he was fired.

Now, clearly, this was a breach of conduct on the coach’s part. But it certainly sounds like it was also a breach on the part of the young men who, as seniors, I can’t bring myself to call “kids.” If they are 17, they’re old enough to drive.  If they are 18, they are old enough to go to war. But they’re not old enough to wait for an hour at a restaurant for their parents to come pick them up?

I fear that the reason the coach was fired was not just that his behavior was legally dicey, but that as a culture we believe that anytime minors are not directly supervised by adults, they are in mortal peril. But they’re not. And in this case, the students were at a restaurant, with a coach quickly by their side, and parents headed over to get them.

We’ve bemoaned the death of common sense here before. This is the death of a couple of other things, too. It’s the death of any faith that our kids can be safe on their own. It’s also the death of a certain kind of faith in our kids — faith that they can roll with some punches, and even learn from cold water splashed in their face.  I’m not one for an eye for an eye, but letting young people experience real consequences for their behavior — even slightly improvised, imperfect consequences — does not strike me as evil. It strikes me as wanting our kids to do better, and believing that they can.

What will the young men learn from this experience? Maybe it’s that they can get away with their antics. Maybe it’s that they were injured and aggrieved. But just maybe it will be that they’ve lost a coach who did nothing worse than think that, when forced to handle themselves in an unfamiliar situation, they’d rise to the occasion.

That’s the kind of coach I’d want for my kids. – L.

Is there any way two high school students can survive for an hour on their own at a restaurant?

Ugh! Now 5th Graders “Can” Go Play — Once a Month, If Chaperoned

Hi Readers! In a post earlier this week we were discussing a great tradition: Fifth graders in Davidson, N.C., who leave school on Friday afternoons and proceed to the town green for an an afternoon of just being kids. This was abruptly declared “unsafe” and ended. Here’s why, according to Davidsonnews.net:

Ms. Nivens [the interim principal] said she thinks fifth graders are too young to be allowed outside home or school without an adult. “Even though it is not a school-sponsored activity, the school still is perceived as encouraging children to be unaccompanied … and to be unsupervised,” she said.

She also worries – though she admits it is “far out there” – that unsupervised children could get into other trouble when they’re alone, such as arranging meetings with strangers they may have met on the Internet. “The world is just a different place nowadays. I just imagine that a child could be on the Internet or Facebook with someone and arrange to meet them there. That would just be a concern that I would have as a parent.”

So now, if a person can dream up a dreadful scenario, it justifies acting as if it’s about to happen? What if I dreamed up the idea that the kids, instead of going to the green, were instead picked up by their parents only to get into a multi-car crash? Sure that’s a little “out there” but it’s not completely unheard of, right? Would that justify the kids NOT getting picked up? After all, I can imagine it.

Anyway, NOW, according to this thoroughly researched follow-up piece, the Friday tradition may be revived — with a nice thick layer of bureaucratic overkill:

A new letter [from school] this week offers to allow the walks once a month – on the fourth Friday – but only if parents sign up with the school as volunteer chaperones. The school said Thursday that kids would not be allowed to walk to the Green this week, since it’s not the fourth Friday.

If they want to go on a Friday that is NOT the fourth in the month (like today), they must be picked up and driven there, or take the bus home FIRST and THEN be driven there.

So what was once a simple throng of kids being kids becomes a tangle of permission slips, regulations and minivans.Huck Finn’s got nothing on these kids!

And, as you’ll read in the story, the shopkeepers were not dismayed by unruly students. For the most part, they were delighted with the kids’ business and already miss it. What’s more, sometimes parents would meet their children downtown later, to shop or go out to dinner. WHAT’S GOOD FOR KIDS IS GOOD FOR COMMUNITY.
